HIPAA is a federal law that limits the amount that a patient may be charged for copies of their medical records. Act 26 is a state law that annually sets specific limits on medical records copying fees that any individual or entity may be charged.
Under HIPAA, medical record copying fees for patients may not include costs associated with searching for and retrieving the medical record. They may be charged for the copying and mailing costs up to the limits set by Act 26.
Both HIPAA and Act 26 permit search and retrieval fees for all other requests.
To determine copying and mailing costs for patient requests under HIPAA, consider:
- Salary and benefits of the person who does the copying
- Cost of the supplies
- Cost of equipment
- The actual cost of postage, shipping, and delivery
